2. Guarantees
All our products are guaranteed by the manufacturer or importer, EUROPAGENCE being a reseller. EUROPAGENCE does not have its own repair workshop or after-sales service technicians. The warranty for all our items is limited to the repair of the defective part or item by the manufacturer or importer, or replacement by the manufacturer or importer in the event that repair proves impossible. Repair or replacement is a “return to factory” guarantee from the manufacturer or importer, never “on site” with the customer. Repair, exchange or replacement does not modify the initial warranty date. The guarantee does not cover the replacement of consumables, abnormal or non-compliant use of the products (always consult the user manual supplied), faults related to accessories (power cable), defects and their consequences due to a repairer not approved by the seller, defects and their consequences due to use that does not comply with the use for which the product is intended. The warranty varies depending on the item. It is indicated on the documents at the time of the transaction. The guarantee does not apply if normal conditions of storage, installation, use and maintenance are not respected. In all cases, please refer to the instructions for use. The cost of carriage to and from the repair site indicated to the purchaser by the seller shall be borne exclusively by the purchaser. No equipment will be loaned to replace defective equipment. The commercial warranty for products sold applies only to the first purchaser in possession of a purchase invoice in his/her name issued by Europagence, and not to any subsequent purchasers of the product. The seller is liable for any lack of conformity of the goods sold under the conditions set out in article L 211-4 et seq. of the French Consumer Code and for any hidden defects in the goods under the conditions set out in articles 1641 et seq. of the French Civil Code.
When acting under the legal guarantee of conformity, the consumer :
- has a period of 2 years from the date of delivery of the goods in which to take action;
- may choose between repairing or replacing the goods, subject to the cost conditions set out in article L 211-9 of the French Consumer Code;
- is exempt from having to prove the existence of a lack of conformity in the goods for a period of 6 months following delivery of the goods (this period has been extended to 24 months as of 18 March 2016 for goods purchased new);
The legal guarantee of conformity applies independently of any commercial guarantee granted by the seller. The consumer may decide to implement the guarantee against hidden defects in the goods sold as provided for in article 1641 of the Civil Code and in this case may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
The customer is expressly informed that EUROPAGENCE is not the producer of the products presented on the site, within the meaning of article 1386-1 of the Civil Code. Consequently, in the event of damage caused to a person or property by a defect in the product, the liability of the producer or manufacturer of this product may be sought by the customer, on the basis of the information appearing on the product packaging. In the event that EUROPAGENCE’s liability as a professional seller is engaged for damage resulting from a product within the meaning of article 1386-6 of the Civil Code, EUROPAGENCE reserves the right to call upon the producer or manufacturer to guarantee this product.
3. Prices
All prices are given in Euros excluding VAT or in Euros including VAT at the current rate. If the rates are modified, either upwards or downwards, these changes may be reflected in the price of the articles.
Prices are quoted carriage paid unless otherwise stated on the site. All orders, whatever their origin, are payable in Euros.
4. Regulations
Payment is made at the time the order is placed by bank transfer or by cheque in euros drawn on a bank domiciled in mainland France. Cheques are cashed on receipt, or on dispatch if so specified on the offer.
If, in exceptional circumstances and depending on specific guarantees offered by the purchaser, payment is made after dispatch of the goods, a penalty of 1.5% per month will be applied for any delay in payment after the contractual date. In addition, from 1 January 2013, any professional who is late in making a payment will be liable to their creditor for a flat-rate recovery fee of €40. 5. Product description
All our products are described as accurately as possible. We cannot be held responsible for any errors. Any operation not contested within a period of seven days may not give rise to a claim except within the framework of the guarantee.
6. Transport, delivery
The delivery charges shown on the site are for delivery to mainland France. For all other destinations, our sales department is at your disposal for road freight rates only.
Products are delivered to the delivery address indicated on your order.
All deliveries must be made in the presence of the delivery person and must be systematically checked before you sign the delivery note. You must indicate on the delivery note any anomaly concerning the delivery, in the form of precise and complete reservations, both quantitative and qualitative (imprecise reservations such as damaged, damaged, open or wet packages are rejected by the carriers), handwritten and accompanied by your signature. You must also confirm the reservations to the carrier by registered letter with acknowledgement of receipt at the latest within three working days following receipt of the package and send a copy of the letter to EUROPAGENCE. If this procedure is not followed, the carrier will refuse any compensation, and the cost of the damage or missing items will be charged to the customer. If the products need to be returned to us, they must be returned within seven days of delivery. Any claim made outside this period will not be accepted. In the event of a problem, please indicate the reason on the delivery note (compulsory) and contact us as soon as possible. If the delivery note is missing, refuse it and contact us. If you are absent at the time of delivery, a supplement may be requested by the carrier, which will be charged to you. We cannot be held responsible for any delay in delivery caused by the carrier.
7. Withdrawal period
Individuals have a period of fourteen days from receipt during which they may return the equipment. Before returning any goods, you must contact us in writing for approval. The equipment must be returned within fourteen days of this written contact, in the original packaging, with a copy of the invoice. Any equipment used by the customer will not be returned or exchanged. The cost of transport and return insurance for returned equipment will be borne by the customer.
This does not apply to products made to measure or with options, which will not be returned or exchanged. The customer will be reimbursed, less the costs detailed above, within 14 days of this written contact, unless the return has not yet been received within this period. In accordance with the French Consumer Code, Companies or Professionals do not have a right of withdrawal in the case of distance selling. Professional purchasers with no more than five employees benefit from the right of withdrawal in the case of off-premises sales whose purpose does not fall within their main field of activity.
8. Applicable law
This contract is governed by French law. The language of this contract is French. In the event of a dispute, the courts of Compiègne and Beauvais (Oise – France) shall have jurisdiction.
9. Deadline
Lead times correspond to average lead times and order processing and delivery times. The deadline for dispatch is set by default at 30 days from the date of receipt of payment (unless otherwise specified in the offer).
10. Retention of title clause
The products remain the property of EUROPAGENCE until full payment has been received by our company. Until this date, the equipment delivered shall be considered to be consigned and the purchaser shall bear the risk of any damage that this equipment may suffer or cause for any reason whatsoever. Notwithstanding any clause to the contrary, in the event of the purchaser failing to comply with one of the payment deadlines, EUROPAGENCE, without prejudice to its other rights, may obtain, by registered letter, the return of the equipment at the purchaser’s expense until the latter has fulfilled all of its commitments.
11. Liability
The products offered comply with current French legislation and the standards applicable in France. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products sold are not contractual. Consequently, EUROPAGENCE may not be held liable in the event of error or omission in one of the presentations or in the event of modification of the characteristics of the products by the suppliers.
EUROPAGENCE shall not be held responsible for the non-execution of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike notably of the postal services or means of transport or communication, flood or fire. The total or partial impossibility of using the products, notably due to hardware incompatibility, may not give rise to any compensation or reimbursement or to EUROPAGENCE being held responsible. In addition, hypertext links may lead to sites other than the ‘handicap-acces.com’ site. The company declines all responsibility in the event that the content of these sites contravenes the legal or regulatory provisions in force.
12. Personal information
EUROPAGENCE undertakes not to divulge to third parties any information that you communicate to us. This information is confidential. Consequently, in accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and object to any personal data concerning you.
